Can ex get custody if I make a decision to homeschool?

I have full legal and physical custody. The homeschooling question has come up with the children ages 6 and 3. If I start to homeschool him can he contest it even though he has no legal right to their schooling. I was told that I have the legal rights to make all decisions on their schooling and am not in contempt as long as he is informed of things involving their schooling. My question is can he use this to take me to court and give him custody? I haven't done it yet but our oldest is ahead of her class and keeps getting into trouble cause she's done first and is bored. I already talked to the school and they can't do anything about that. They said they don't skip grades or give extra work. Homeschooling seems like it might be my best shot to help foster her intelligence since I can't afford private school. I just want all bases covered before I even bring up the subject of homeschooling to their father. Thanks for any info you can give me.
