    Just need to know how far back they can go for felonies and if they have a right to check background without permission

    There are dozens of apps and website which allow ANYONE to run a background check.

    As a lawyer, I subscribe to several of them.

    However, anyone who wishes to pay the required fee, can subscribe to their services.

    Most states also allow anyone to check a person's background:

    Yes, an HOA or anyone can check a person's criminal history.

    Why?

    Because all court proceedings in this country are open to the public.

    Anyone may legally search public records going as far back as they're available, with or without permission.

    I would not call "check[ing] background" a "right," but there's no law preventing such a generic thing. There are, of course, laws that prevent certain types of investigation and the use of particular bits of information.

    What exactly is it that you want to know, and what is the situation that led you to post about it?

    why was the HOA doing a background check? What do the Covenants and Restrictions state?
