Suggested for the process of elimination a drug screen for newborn. Mother refused stating she did not do drugs has no legal history of doing so and was in fear of what a possible False Positive result might bring to her legally and with social services. Hospital performed test nonetheless, negative. What legal recourse does this patient have? Did the hospital violate any of her or her newborn child's civil rights? Can a hospital entity randomly without consent, without a judges writ, perform drug screen tests on patients that are uninformed of the procedure? Or that perform the drug screen against consent of the patient?

I am not an American lawyer.

As I understand American constitutional law, assuming the hospital performed the test for legitimate reasons pertaining to the health of the child, and not to find potentially incriminating evidence against the mother, they did not violate anyone's rights.
