Hi - My husband was divorced in CA in 2001, mother to have children 2/3 of the time, father 1/3 of the time. Mother did not cooperate with visitation, cut it short, made other plans for children, did not honor vacation schedule (took more than stipulated time herself, made plans for the children for the rest of the summer so father could not have 2 weeks as per order), did not honor once a week visitation in addition to every other weekend. Lots of negative information about father to children, and after our marriage about both of us. My husband lost his job and we spent two years trying to stay in the area, and he could not find a job in his field in the area. We moved to WA. Mother verbally agreed to give father 1/3 visitation and has not honored it - only a week or two in summer and a week at Christmas. Now she has gone to DA and asked for additional child support based upon the additional time she has the children. My mother in law, the children's paternal grandmother, provides all the children's clothing and entertainment expenses. My husband pays child support as ordered, we provide extra money (band trips, year books, etc.) and we pay for all visitation expenses ($850 this month for a week at Christmas).

We need advice on how to respond to DA. Do we just fill out income and expense forms and let them use the dissomaster? Or do we try to get credit for visitation expenses, and how do we do so? Can the DA use the amt of time the children have been with the mother rather than the amount of time ordered? Does the money provided by my mother in law for the children's expense get figured into the mix?

Thank you!
Michelle
