Ive been working two years being underpaid Im thinking of quitting and suing my employer my question is that I havent file income tax returns those 2 years will that make any difference on the case?
 
Have you been paid at or over California minimum wage?

Do you have a legally binding and enforceable contract or CBA that guarantees you a higher wage than you were earning?

If the answer to these questions are yes to the first and no to the second, then you will lose a lawsuit for "being underpaid".

And yes, the fact that you have not paid your income tax for those two years means that you do not want to bring that fact to the attention of the authorities.
