Battling Unfit Mother For Custody

My husband's ex has custody of their two daughters, ages 13 & 12. She has a younger daughter from a later marriage that she does not have custody of. My step-daughters are home alone usually until 6:00 in the evening, when their mother comes home from work and either gets ready to go to a bar, or barricades herself in her bedroom with varying men, leaving the girls to fend for themselves. This has been ongoing for a couple of years now, with police and DHS being involved once. DHS investigated her and recommended counseling. The 12 year-old wanders around on her own at all hours of the day and night, most usually not even riding the school bus home, but going wherever she chooses. What is the best way for my husband and I to legally gain custody of his daughters? Will the girls' right to choose be a factor? They will choose their mother because there are no boundaries or rules. HELP?!!!

Hoping that you meant well with that reply and that you weren't trying to insinuate that my husband & I are stupid people, I feel I should tell you that we do have an appointment with our attorney in 2 days time. I was hoping that someone might be able to give us a general idea of the direction our attorney may take. And also, it never hurts to have a little extra knowledge...

Without reading this Attorneys mind or knowing full details we cannot or should not speculate.Once more I must remind you this its not your fight your a legal stranger.

Okay, maybe I should state the obvious. If the only answer ever given to anyone is, "seek an attorney", what is the point of this website?

This site is run by volunteers. Not all are Attorneys and not all the Attorneys work in topic field or in said area as laws vary by state sometimes counties. This site helps with knowledge of certains, simple google searches and interptation and/or explanation of laws. We do not give legal advice. If we did and you took it your not very bright. Your best legal advice comes from your Attorney. Not message boards, chatrooms, friends or the like. Would you come to a message for to learn how to pull your own teeth or go to Dentist? We give opinions we give laymans terms to legal events and laws. We ar enot your Attoreny and do not reperesent you. If you got that assumption I am sorry and I believe there is a discalimer to read when you join explaining that. You want legal advice go to court and seek chang ein custody him not you! You are a legal stranger. That is your answer. Wait you wan tmore? Like what outcome? Sorry no crystal ball here. How should you proceed? Now you need an Attorney familar with your state/County laws, judges, and DA's, when it applies.Do not trust faceless people of unknown backgrounds, educations and expereince for a matter so important. Talk to your Attorney if still confused comeback maybe can clarify.I do hope this helps

I understand your point. I'll clarify the type of information that I'm looking for. What course of action may be taken? We have a consultation scheduled with our attorney, but what would the advice be if we didn't and couldn't afford one? And I'm not one to ride a dead horse into the ground, but may I point out that the logo here says: "Providing free legal advice since 1995..."?

May I point out two things? 1. You have an appointment with an Attorney in your area skilled in this field. Whom can give you the legal advice you desire 2. You are trusting unknown people of unknown educations, backgrounds opinions etc to such a delicate matter. Your best advice comes from your Attorney. The legal advice sites like this provide is copy and paste of laws or laymans explaination of laws. Your situation is not that simple. Even if you do not hire an Attorney the consultation will tell you which direction to move. We donto know all the details and it would be unfair to guess for you and possibly hurt your case. Once more this is not a simple matter to google a law and post it for you
