bank set off rights

I had a credit card in my name only, and the bank recently used set off right to raid wifes account(i am joint on it)of money that was earned by her. Easily proven by direct deposit records. Does she have a small claims case against the bank or does their right to set off preclude any actions against them? Can someone reference a Florida law pertaining to this set off? Thanks Dacre

Yes they can do this-- in your contract when you signed up with them, they have a clause in there about cross collateralization-- meaning if you go bad on one account then all accounts are bad-- your wife can sue them however they will bring the signed contract into court showing where you signed it and she signed it-- I don't know of a Florida law however it should be in your contract-- ask the bank for a copy of it.
