If a contractor installs a damaged bathtub and denies any liability (refusing to fix it) can I stop payment on the check or do I need to pay him per the terms of the contract and then take him to court?
The problem is that I need the bathtub fixed immediately so I am not without a bathroom so I have to hire someone else to fix it if he won't.
They also caused water damage to the bathrooms in the condo below me by cutting the pipes TWICE. They keep saying they will come out to look at it but they are delaying it. The damage happened 4 days ago and the people below me are anxious to make sure their ceiling is ok.
