At what age can a child get his own lawyer to decide where he want's to live? My nephew is 11, his mom has him, she has custody by default only because his father has never wanted anything to do with him. His father will see him occasionaly, barely now. The problem is the mothers boyfriend who lives in the house and has a criminal background, he has not gotten physical up to this point but I am worried that it can end up to that point.

Dad can ask for custody but this does not mean he will get it. GAL's cost alot of money, is Dad prepared to spend the $$ to hire one? What crime did the oyfriend too? If he is violent and the child is scared of him, he may have something to go on, but you cannot get custody based on what the boyfriend might do.
 
I don't think dad would take him. Boyfriend is regis. sex offender. Offended an adult not children so police have already told me I can't do anything with that information. Also I think according to superior court website he also is registered drug offender. I don't know who to call to find out his legal history only what I have been able to find out on the internet
