Assault Class C misdemeanor Domestic Violence & Civil Orders

    I was taken to jail for pushing my girlfriend due to her trying to hit me and I was charged with a class C misdemeanor for assault. It's my understanding that should not warrant a trip to jail.

    If you're arrested, or cited with a traffic violation, the officer can decide to transport you to jail.
    In most cases, and you're cooperative, you can be cited and released.
    That's an option, not a right.
    It's also up to the officer's discretion.
    You're lucky you weren't charged with domestic violence.

    Whether it was appropriate or not is something to argue in court when the time comes. If you are facing a domestic violence charge you should have an attorney at some point who can review everything for you.
