Does a married couple in Arizona HAVE to file bankruptcy together?
My daughter's husband has made a lot of stupid decisions like owning 42% of a company, re-mortgaging their home with the company and then getting pushed out by the other partner. So the house payment reverted back to them!
He also sank $25K of their money into the company "for advertising" and I question why he cannot recover any of these funds or why this company is not buying him out since they chose to push him out.
(still don't know how that happened without him knowing about it)
Now they are stuck with a $4000 monthly house payment and her husband wants to file bankruptcy and let their home be foreclosed!
The home is in his name only and so are most of the credit cards.
My daughter has had very little credit in her name but now has to share this mess with him.
I have the feeling he thinks the only way out of this is to file bankruptcy and live with that.
