My daughter lives in Minnesota. Her ex-boyfriend (father of her 3 month old child) moved out of their apartment before the baby was born. He filed for a paternity test (instead of signing a ROP) and he is the father. Now they will go to court for child support. He has been paying her child support since May so the court won't go back to her birth and charge him back child support. However he also said the formula and diapers he has been buying should also be considered part of the child support. He said he kept all receipts and will present them to the judge at their child support hearing. Everything I have read indicates diapers and formula are considered 'gifts' and not part of any child support payments. His check he gives my daughter says 'child support' and she will acknowledge this money as child support, but not formula and diapers. He has the child sometimes so he needs to keep diapers and formula at his house. Plus I think his mom is really the person buying the diapers and formula - although she says he pays her back. How can they proove he gave her the formula and diapers?
