We are in a contractual dispute with a company where our contract with them states that we have to go to arbitration to resolve disputes. However, the other party now states that they refuse to go to arbitration unless it is non-binding. We feel that we have a strong case and that the reason they want it non-binding is that they will not win it.
Basically, we feel we are in a no-win situation as we are insisting that arbitration should be binding on both sides. Can we somehow "force" them to accept the binding nature of arbitration? If not, do we have any options?
