My jurisdiction is: western washington bankrruptcy court
we are unable to find who we are to appeal directly to when appealing the dismissal of a chapter 11 case in its entirety by the bankruptcy and who to ask for a stay while the appeal is in process. We don't believe we can go to the judge in question because our appeal and request for stay is based on abuse of Judicial Discretion. The case in point was allowing testimony and a motion to be heard with only 3 days notice and then granting an order based on the testimony given on the lack of notice. Our only response was the notice wasn't proper and we were not prepared for rebuttal and protested the motion on the lack of timely filing. Other items were heard outside the scope of theri motions also. The dismissal has severely damaged our business and we are strugling to survive . With out the appeal and stay the IRS and Dept of Revenue are brutalizing us.
Who do we go to for the stay? Our previous attorneys abandoned us because they would not appeal on grounds of Abuse of Judicial Discretion as they are professional bankruptcy lawyers who must face the judge constantly and don't want to damage theri relationship
