hi this is my first time on here so bear with me.....my ex has custody of our daughter who will be 1 year old in june. she has custody and i have regular visitation. my ex however doesnt take care of my child. she leaves her with friends for days at and also time and leaves her with her gramndma most of the time too. my daughters mom only sees her about once a week or so yet she has custody? can anyone tell me how emergancy custody works and the best way to go about it because if you ask me my ex is neglecting our child.

It does not sound like neglect to me. If you want custody or more visitation then you go to court and ask for it. I doubt you will be granted an emergency motion. The baby does not sound like she is in any danger. you have the burden of proving neglect. Now what you can d is ask for first right of refusal meaning if mom cannot watch the child for more than say 4 hours, she has to offer you the child first before the child goes to a babysitter or grandmas.

my daughters mom is trying to give her grandma legal guardianship but it requires her signature and my signature (im not signing it) so if i take the paper in front of a judge with HER signature and NOT mine then what are my odds of being granted custody of our daughter???
