We have a judgement against us because we voluntary turned in a truck which we could not make payments any longer. I am disabled and am on disability. My husband retired and is on social security and a small retirement from the Army. A law office is threatening filing a formal supplemental proceeding against us. It would require our appearance in their office or in court. Thier office is almost 400 miles away. It states if we fail to appear as ordered by the court they will request the court issue a civil arrest warrant, all in accourdance with Arizona law. It states we will be required to give sworn testimony about all of our financial affairs. We will be required to produce several financial records or their examination and reproduction. Can they take my disability? My husbands social security? My husbands army retirement? The letter is to my husband and does not have my name on it. Can they actually arrest my husband for this? I am scared because I need him home to take care of me.
