You can file a lawsuit for almost anything.
But, before you get too elated, a lawsuit alleging adultery in CA will fail.
You are free to divorce your philandering, cheating husband.
In your state, you'll get HALF of everything you've accumulated during your marriage.
See a good divorce lawyer, and sue the male bum.
The female bum owed you no duty to leave your cheating husband alone.
However, your cheating husband is the one that did you wrong.
Divorce his loser carASS.

In case the spouse is the wife, just change husband to wife in prior post.

Yes, it could be so, Betty.
But, I've never seen a man think about this way to remedy such a situation.
I've been asked this question by women only in the years I've practiced law.
But, you have a valid point.
The planet has changed, for sure.
So, it would certainly be possible the term husband could be wife.
It might also be man married man, where many of those marriages use the traditional identifiers, wife and husband.
I've also seen that used by woman and woman locked in matrimony, wife and husband.
I don't think I'll ever get it right.
I is two dummy to learned meself betters.

The penalties for committing adultery vary widely from state to state.
In your state, California, adultery is not even a ground for divorce.
However, in South Carolina, adultery is a criminal offense punishable by a fine of up to $500 and a jail sentence up to a year.
Depending on where you live and how you choose to legally address the transgression, the court could either not hold your spouse responsible for straying or award you a monetary settlement for his or her infidelity.

There are other torts for which one could pursue adultery.

I recommend divorce, it cures all the ills of any ailing marriage.
But, divorce possesses its own ills, too.

You may sue anyone for anything at any time. We are not saying you cant. However winning might prove difficult and even if you win collecting will be even harder
 
If I were you, I would forget it - your decision though whether to pursue.
