401k - Estate- no will

My dad died 7 yrs ago, now got a letter saying he has 401k less than $75,000. He had no will and no assets,I am only heir. Trying to find out how to get proper probate form to file with the court. The letter says I need a Court Appointment of Adminstrtor of Estate. Please help!!

Well, you start with the county you desire to probate the matter.

Now I found a will from 1977, I'm in the will and all exucters are dead and divorced. Does that count me as an adminstrater to my dads estate?

If dad died seven years ago, that will is likely to be useless.

I suggest you speak with an attorney in Florida. The initial meeting is often at no charge. Take all of your documents and ask all of your questions.
