My 17 year old nephew had sex with his 14 year old girlfriend. A few months later (after she turned 15) she told her mother, who contacted the police. The police went to his high school and took him to the station for questioning and after admitting they had consentual sex he signed a statement. Now they are charging him with statutatory rape although the girl admits it was consentual and at no time was he represented by an attorney or read his rights. Also my mom (his guardian) was not even notified that they wanted to speak to him. Is the confession legal? Can it be used against him since he is a minor and was not read miranda rights?
