Im being charged with a PV for a dui back in 96 that I should have never
plead guilty to .Ill try to explain this,15 years ago my girlfriend (now wife)
and I used to have one to many cocktails and then get on a subject
we didnt agree on,pretty much the recipe for a loud domestic dispute.
Anyways one night things got out of hand I said I cant argue anymore im
going to bed.I guess my wife didnt like the fact that I could just end this
on my terms,so she jumped on my back when I was walking down the hall
and I fell back on her and she broke her finger,someone heard us argue earler
and had called the cops,I was arrested for DV and later charged with two
counts of measure 11,very serious.About a month later another alcohol
induced verbal argument sent the cops to our house where i was sitting
in my boat on a trailer in my driveway and they arrested me for DUI.on
the grounds that at sometime that evening one of the cars had been
driven because the engine was slightly warm.Anyways my wife wrote a
letter to the DA explaining that it was her fault her finger got broke and
she wont testify against me.I had a public defender on the case because
I had to get a release hearing to get out of jail,Anyway very worried about
the measure 11 charges I get a call from the lawyer stating If i plead Guilty
to the DUI the DA will drop all the other non related measure 11 charges,
Did it like a fool went to a years worth of AA classes had one class left
another argument,visit from the cops,said they could smell alcohol reported
it to my PO,she issued a warrant for PV that was in 1998.I got pulled over
in a boat for expired tags a month ago and got takin in on the warrant,
The jail recoged me in 10 hrs.I contacted the county about fines owed,
it was $980.00 so I paid it in full.We are completely different people now
we havnt touched a drink in over 8 years or have argued about anything,
Ive had no police contact since 1998,we are both in our early 40s,this BS
happened we were in our 20s,The PO who is new the old one retired,wants
to throw me in jail.If i go I will lose my job,the devistation this will have on
us is beyond measure for i am the only one in the state of oregon that does
what I do, There is no possible way to get a replacement job in my field.
Any suggestions or advice about my situation would be greatly appreciated.
