    petty theft investigation

Ditto all of the above - no one has to tell you. If you ARE being investigated, the police will almost certainly come calling. If they do you can exercise your right to remain silent, or, you may speak to them. Your call.

can you find out who turned you into cps

I have been at this long enough to see the child witnesses grow into abusers and victims, themselves, because they see mommy and daddy and decide that these dysfunctional relationships are normal. :(

can you find out who turned you into cps

In many (most?) states CPS can take the report and will be required to cross-report the issue to the police, but they can also investigate and petition the court to remove the child. CPS does not always need the police to be involved at all. The point is, it is the law and policy in almost...

can you find out who turned you into cps

Well, to be clear, CPS actually WILL care if you thump your spouse or significant other because it can be considered child abuse or neglect - particularly if it occurs in the presence of the children. I can't speak to VA, specifically, but many states require or encourage law enforcement to...

Mental Health Thread #8 - Fall is here!!

Happy? Ugh ... lessee ... Friday night, college town nearby, mutual aid already requested, rumors of gang "initiation" to include shootings, students from around the region descending on the area ... oh, yeah - "fun!" On the plus side, it ought to be real quiet in my town as everyone will be...

    police on your property

CAN they? Sure. It all depends on why they are there and where they went. Whether they should, or whether any actions they take might be suppressed or actionable in a civil court would depend upon the nature of the actions.

    Homicide, Murder, Manslaughter once1always1??

No, a person can be referred to as a "murderer," "killer," "felon," etc. for as long as people want to say so. A felony conviction stays with you forever unless overturned or expunged ... and manslaughter is not likely to be expunged (assuming it is even possible in your state). So, he will...

    probation officer abusing resources

Oh!! You should have said that from the outset! Yes, that would be illegal! Whoever has firsthand knowledge of this activity should report her to her office, local law enforcement immediately, or the Texas Department of Public Safety as I believe they have responsibility for the statewide...

    probation officer abusing resources

Okaaay ... that doesn't mean there was not a legitimate purpose. The PO might be running the names to identify who the probationer is associating with - there could be a good reason. We do that from time to time.

    probation officer abusing resources

For PERSONAL reasons? As in, not work-related at all? Then, no. But, if ostensibly for some work reason, sure! And, yes, the inquiry is saved and can be looked up generally at both the local and the state level. Perhaps you'd care to add a few details/facts?

Mental Health Thread #8 - Fall is here!!

Perhaps the court in your state will issue an arrest warrant for contempt of court. That might help. Very often court orders for custody from one state will have to be affirmed in another state before they can be enforced. It can be a sticky wicket.

Mental Health Thread #8 - Fall is here!!

And Ferguson may not be the example of jackbooted policing that many seem to think (or want) it to be. It's also where there were protests because an officer had the audacity to return fire after he was shot at and the suspect was killed ... THAT makes no sense to me at all. Certainly there...

Help with fighting 1 VC-22450A-I in writing

If he fights and loses, he can pay the fine and ask for traffic school to keep the point off of his license record. However, if he is eligible for traffic school, he will almost certainly be permitted TS if he pleads guilty or no contest at the outset, but if he goes to trial and loses, the...

Mental Health Thread #8 - Fall is here!!

My thoughts on an event this weekend that has tempered my normally ebullient mood: In recent weeks and months, it seems to have become 'en vogue' to assail law enforcement as militaristic, heavy-handed, thuggish, and even downright evil. We have seen rallies against questionable actions by law...

If he has taken traffic school within the past 18 months, then he will not be eligible to do so again and will have to pay the allocated fines. It's not fighting the cite that is the issue, but whether he took traffic school or not.

Help with fighting 1 VC-22450A-I in writing

If he is not eligible for traffic school, he may have little to lose but time and money (if he doesn't get paid for time off of work) by fighting the ticket. He might get lucky and the citing officer may not respond to a TBWD or to trial.

Help with fighting 1 VC-22450A-I in writing

VC 22450 requires you to stop AT the limit line ... not after, and not before. Once he traveled over the limit line without coming to a complete stop, he was subject to citation. If he wishes to contest the matter via trial by written declaration, he can, but he has no real defense. Assuming...

Other Criminal Procedure Don't use please help

The police can talk to most anyone they wish. The only time some state law might apply is when the situation becomes a detention or greater.

Other Criminal Procedure Don't use please help

Whether a parent must be present when a juvenile is interrogated by the police depends on two things: The circumstances, and what state you are in. There is no federal law that I am aware of that covers this, and if there is it does not apply to state and local law enforcement. In some states...
