    General Power of Attorney

How do you mean, you are both to be appointed attorneys-in-fact? Co-attorneys, required to act jointly? One will be an alternate? Each to have full power? If so, how are disputes to be resolved? In answer to your questions : 1. It can be done, but I don't recommend it. POA laws vary...

    sealed arbitration award

Examine the witness under oath before trial, find out what evidence they will give at trial, get them to disclose how they obtained a copy of the award. If their evidence is damaging to you, seek to have them excluded.

Former Employer Placed Charges on Canceled Amex Corp. Card

I'm a little confused by this, and I suspect there is more to the story. Give us the timeline of events here. And how did Amex place a charge on a card after it was closed? What was the charge? If it is a corporate card, why are you liable to pay it?

    Consumer Law, Warranties Gym Contract

Have you contacted your AG's office to file a complaint? What, if anything, did they say? Without knowing the terms of the contract, it is impossible to say what the ramifications are. If it was a condition of the contract that you were to have access to the affiliated gyms, then the owner...

    Can I still sue

Sure you can still sue. You don't give your jurisdiction, but wherever it is, you're probably still well within the statute of limitations. It is unclear whether you should win. How was the park owner at fault?

I hit a parked car & I think the owner is trying to scam me

You hit her car and wrecked it. She's entitled to the value of the car, which she is going to receive from your insurance company. She is not entitled to anything above that - so I don't know why you'd offer anything more in the first place. If she DOES get anything more from you, she's...

    Money Loaned to a Friend

You can sue him, and you might win, but collecting on a judgment against him in whatever country he lives in could prove exceedingly difficult. He might become hard to find again, and what are the chances he has any assets?

    reversing an injunction

When they got the injunction, they likely had to file an affidavit stating the grounds for their belief that your wife was a threat, etc. Apply to court to have the affidavit lifted; you'll need to file a counter-affidavit to the effect that your wife is not a threat. If you want to have an...

Corporate Law Should one have access to all business documents as 50% owner in a LTD business?

What the shareholder is entitled to depends on the company's bylaws and articles and the local Ohio business corporations laws. I don't know what Ohio's laws are, but many jurisdictions do NOT give shareholders the right to request those documents. The articles of incorporation are often...

    Can a Trustee get "back-pay"

She can try for it. You can object, and a court can decide whether she should be entitled only to the furniture and car, or what more she is entitled to if anything. I would note that trustees are usually not contractually bound to the beneficiaries; the trustee's compact is with the testator...

    Neighbor's Nuisance Trees

You can send the owner the bill for any damage to your property, and sue them if they don't pay.

    Where Did My Lawyer Go?

You absolutely have cause to file a complaint, and I like your chances of getting your fee back. Instead of going to small claims, you might wind up challenging the lawyer's bill with the court's "taxing officer" or whatever they call the person who fulfills that function locally. If you...

    Obtained Property by false pretense?

I can think of one good way to find out: get a lawyer to find out the particulars of the case for you. If I had to guess, I'd guess one of the persons whose junk car you hauled away has decided it was worth more than you gave them for it and thinks you obtained it unfairly.

    Neighbors Pool or pond...

Sure they can call the police. What the police will do is anybody's guess. In many jurisdictions, trespass to land is just a civil tort, not a criminal wrong. I expect even if it IS a crime in the jurisdiction, the police would laugh at them and tell them to call the parents, or simply walk...

    Okay I've been scammed...

These are not mutually exclusive options. In either case, you wait. My suggestion would be stop pursuing the new buyer. He's out $4600, if he wants it, he will no doubt come and get it. How long he has to sue depends on the jurisdiction, which you can look up here (under "written...

    Ser Reply to a motion

I think you mean "surreply" or "sur-reply". What do you mean, "case law in favour of this"? Whether a party is allowed to file one depends on the rules of civil procedure of your un-named jurisdiction. Whether it is persuasive depends on how good it is.

Consumer Law, Warranties Is E-Mail notification of loan forgiveness binding

Have they taken legal action without notifying you? It would be nice if they would notify you. I don't know that it's legally required.

    Neighbors Pool or pond...

Liable for what? I HIGHLY doubt people installing a pool or pond are under any duty to notify the neighbours. They may, depending on where you live, have a duty to install a fence or otherwise take precautions to prevent people from wandering into it.
