    scandalous employees and employer

And if this place was so terrible, why are you working there AGAIN? (banging head on wall here)

Time theft as a salaried employee

That very well may be, but being the "black sheep" is not an illegal reason to fire you either.

Time theft as a salaried employee

What other employees do or don't do does not relieve you of the responsibility of working the hours to which you agreed and clocking in/out as the work rules require. Nobody "forced" you to resign unless there was a gun being held to your head. Having said that, though, most states consider...

Can I be fired for needing medical attention for possible cancer?

Even though I have this poster on "ignore" so I don't see what he posts, I could have probably given the same response without seeing what he posted.

    workmans comp in appeal status...terminated!

Sorry, no, FMLA was only for 12 weeks (even though your employer extended your leave, the additional 4 weeks wasn't FMLA) and as such, your job was no longer protected.

    Laid Off During Illness

All other requirements being met, being out "only" 5 days does not preclude the absence from being FMLA-qualified.

While I don't necessarily disagree with ArmyJudge, OP, the answers to my questions are necessary for a valid response.

    Laid Off During Illness

Even if you were on FMLA leave during this period, that would not mean you could not be laid off. Even FMLA does not protect your job against an action that would have been taken anyway. WERE you on FMLA leave and, if so, do you have any credible proof that your "lay-off" would not have...

Sorry, missed that. Oops. Then what AJ said. :)

My employer wants me to work for 2 days with out pay

However, unless the OP comes back and answers cbg's question, nobody here can give him the legal answer.
