They already sent one replacement and will refund you for the second once it's returned. You have no basis for suing the vendor.

Lasts???? What are you asking?? Your "witness" is biased and his statement is likely to be disregarded. You haven't really provided many details about the collision. It's likely that this will be handled under no fault, i.e. you both share blame equally.

So you never thought to at least mention to your wife your intention to trade in one of the family vehicles and get another one? Major events such as that are usually discussed ahead of time. I doesn't sound like you communicate very well in your marriage or you don't think very much of your wife.
