  • Hi, Duranie. I was wondering if you could answer this question for me? My 13yo daughter signed affidavit that she wanted to come and live with me 2 months ago. She will b 14 on Sept. 3. My attorney cannot get the judge to respond. We have had a temporary physical custody order for more than 2 years now. Judge Joe Bishop, Georgia, has yet to respond at all to our request for a hearing and/or temporary custody change until a hearing. How long can he keep ignoring us and is there anything I can do?ring if you could answer this question for me?
    Hi there, I was really hoping you might be able to help me out. I know your probably very busy but I have a couple questions if you wouldnt mind.

    I have a friend that has been charged with Assault IV and Criminal Mischief (vandalizing an auto) in Marion County Oregon. I am curious of the minimum and maximum sentences for these charges. The first court appearance is next week, what should they expect at that time? Should they get an attorney?

    I WAS ARRESTED EARLIER THIS MONTH FOR OHIO REVISED CODE 2917.11(B)(1) WHICH STATES...§ 2917.11. Disorderly conduct.

    (A) No person shall recklessly cause inconvenience, annoyance, or alarm to another by doing any of the following:
    (1) Engaging in fighting, in threatening harm to persons or property, or in violent or turbulent behavior;
    (2) Making unreasonable noise or an offensively coarse utterance, gesture, or display or communicating unwarranted and grossly abusive language to any person;
    (3) Insulting, taunting, or challenging another, under circumstances in which that conduct is likely to provoke a violent response;
    (4) Hindering or preventing the movement of persons on a public street, road, highway, or right-of-way, or to, from, within, or upon public or private property, so as to interfere with the rights of others, and by any act that serves no lawful and reasonable purpose of the offender;
    (5) Creating a condition that is physically offensive to persons or that presents a risk of physical harm to persons or property, by any act that serves no lawful and reasonable purpose of the offender.
    (B) No person, while voluntarily intoxicated, shall do either of the following:
    (1) In a public place or in the presence of two or more persons, engage in conduct likely to be offensive or to cause inconvenience, annoyance, or alarm to persons of ordinary sensibilities, which conduct the offender, if the offender were not intoxicated, should know is likely to have that effect on others;
    (2) Engage in conduct or create a condition that presents a risk of physical harm to the offender or another, or to the property of another.
    (C) Violation of any statute or ordinance of which an element is operating a motor vehicle, locomotive, watercraft, aircraft, or other vehicle while under the influence of alcohol or any drug of abuse, is not a violation of division (B) of this section.
    (D) If a person appears to an ordinary observer to be intoxicated, it is probable cause to believe that person is voluntarily intoxicated for purposes of division (B) of this section.
    (E) (1) Whoever violates this section is guilty of disorderly conduct.
    (2) Except as otherwise provided in division (E)(3) of this section, disorderly conduct is a minor misdemeanor.
    (3) Disorderly conduct is a misdemeanor of the fourth degree if any of the following applies:
    (a) The offender persists in disorderly conduct after reasonable warning or request to desist.
    (b) The offense is committed in the vicinity of a school or in a school safety zone.
    (c) The offense is committed in the presence of any law enforcement officer, firefighter, rescuer, medical person, emergency medical services person, or other authorized person who is engaged in the person's duties at the scene of a fire, accident, disaster, riot, or emergency of any kind.
    (d) The offense is committed in the presence of any emergency facility person who is engaged in the person's duties in an emergency facility.
    (F) As used in this section:
    (1) "Emergency medical services person" is the singular of "emergency medical services personnel" as defined in section 2133.21 of the Revised Code.
    (2) "Emergency facility person" is the singular of "emergency facility personnel" as defined in section 2909.04 of the Revised Code.
    (3) "Emergency facility" has the same meaning as in section 2909.04 of the Revised Code.
    (4) "Committed in the vicinity of a school" has the same meaning as in section 2925.01 of the Revised Code.
    ALL I WAS DOING WAS STANDING BY THE POLICE CAR TALKING TO THE GUY INSIDE THE THE CAR THAT HAD ALREADY BEEN ARRESTED.I WAS NOT DRUNK BUT DID HAVE 3 SHOTS OF ALCOHOL IN 6HRS. I DIDN'T TOUCH THE CAR AND WAS GIVEN NO WARNINGS TO GET AWAY FROM THE VEHICLE OR TO BE QUIET. NO MIRANDA RIGHTS WERE READ AND I WAS CHARGED AND RELEASED. UNSURE OF WHAT TO DO? PLEADED NOT GUILTY CAUSE I CANNOT POSSIBLY PLEAD GUILTY TO SOMETHING I DIDN'T DO. NEED SOME INSITE ON HOW THE COURT THINKS ON THESE SORT OF ISSUES.
    I am writing to find out what i need to do. We have a family friend who is 14. She lost her mother a couple years ago and is now living with her step dad and half brother and step brother. She has no idea who real dad is or even if he is alive the last she heard he wasnt. Her step dad does not have legal custody of her only a marriage licence showing that her mom and him were married. She does not like her situation./ Her step dad is recieving death benefits through Social Securtiy on all three children. She does not see a dime of that money. What can we do legally to have her live with us? We live in Arkansas.

    Heya, 1 year ago i needed some money so i asked my ex girlfriend who was my friend then for the money, so she gave me the money and neva said that she wants the money back and now she is threatining to take me to court now if i dont pay her the money back but i said that u neva said u wanted this back because we used to give money to each other when we were together.. now i have a baby n my girlfriend and i dont want to have this black mark. please give me some nice advice.     I purchased a used veheicle and bought the extended warranty. Last March the transmission went out. I called the dealership and they said the warranty was expired. They quoted me a way to expensive quote for repair. So i had the work done some where else. As of today I have another issue and when I called the service department this time they told me that my warranty was still valid. After speaking to the service department manager and explaining to him what happened in March he said he would take the matter to his boss. Do I have a law suit pending if they do not reimburse me the cost of the transmission repair??????

    I have a court date comming up next month in Gulf Shores Alabama for DUI, speeding and No DL. I need to report to work out of state before the court date and cannot afford to loose my job, we are also considering moving and leaving the area before court, what will happen if I do not show up and leave no further contact information?     Hi, I recently sold a motorcycle, my buyer had issues with it, and now is sueing me for a ridiculous repair cost, even though I offered to help him fix it for 1/4 the price the shop quoted him. After he took ownership he had mechanical difficulties, crashed the bike due to his own negligence(not directly because of the aforementioned mechanical issues), had the estimate for damage done after the crash, and after he had had ownership for a week. My full story is listed under the "small claims" category. Any help with advice on where I stand legally is appreciated. Thank you.

    I signed a contract reserving a boat slip for summer 2008 and sent a $1000 deposit, to reserve it. This was due on Feb 1st.

    I had unexpected surgery in April and called the marina in April to let them know that I could not put my boat in this year. I asked that the deposit be applied to summer storage. I received a invoice for summer storage on July 1st.

    They told me because I notified so late that they would charge me a for the slip until they could rent it.

    There was no language in the contact that the deposit was non-refundable or that any terms with conditions such as prorating. It does say - If you do not want your slip to notifying them so they can open it up to their waiting list.

    They wrote this to me today:

    There were a few other customers who sent deposits and wished to break contract for various reasons. To be fair to all, we rent the slips available based on dates the customers called to advise us, first come, first serve. Those customers notified us as early as February and March and were aware that we would return deposits based on re-rental date of the slip. For your information, we were able to return some deposits. Others forfeited based on ability to re-rent until later in the season.

    Can they do this without it being spelled out in the contract?
    Hello I have a few questions. I was charged with a misdemeanor while I was living in savannah..I went to two of the court dates...the last one I went to they told me I could find a lawyer..Now a year later I looked up my case and it says I failed to attend a court date..which I knew nothing about and I have a warrant out for my arrest. I do no have a lawyer still...and I do not know what to do.

    last night my son was almost arressted: the office tried to conveince me that he would be charged as an acomplis to a theft which would violate his prohbation. the video surrvalance tape shows my son and his friend at the cash register, his friend picks a cell up belonging the customer prior to them and leaves the store. the owner of the phone returns, cell phone gone and my son standing there not knowing what they are talking about. the officer tells my son he can be arressted for being with this boy-tells my son to find him bring him in or he (my son) will face the charges. Can this happen?

    Hi, I Have A Question About A Fradulent Inspection Sticker. I Was Stopped And Given Two Tickets..1 For Failure To Inspect And 2 Fradulent Inspection Sticker. The Sticker Was On The Truck When I Brought It. Will Any Judge Believe Me? I Am Not Sure Of The Woman's Name Who Sold The Truck To Me. Will This Hurt My Credablity?
    How long is too long when waiting for your court date

    My husband has been in jail waiting for his day in court. Eight different dates have been set only to be reset. The first five dates had such titles as check status, disposition settings and etc. The last three dates were for a hearing before the judge and all have come and gone. The hearing was scheduled to present case law to the judge that will prove that my husbands offense should have been classified as a misdemeanor and not a felony. We can't prove this if we never get our day in court. Meanwhile my husband sits in jail under an outrageous bond and his length of time in jail has surpassed the punishment length for a misdemeanor. Our attorney isn't helping to speed this along and most of the time I can't even get him on the phone. What can I do? Who do I need to contact? Please help!!!

    I have a question. I live in Cedar Falls, IA and a couple nights ago I recieved a public intoxication blowing .389 b.a.c. in the field. I refused to blow in the station. Then also recieved a 5th degree criminal mischief for punching out a window at a bar. I have talked to the manager of the bar and I will pay for it. I have decided to plead guilty to both tickets. Would you recommend a lawyer? How much in fines do you think fines wise im looking at? And will there be any other immediate consequences from the court? Please help me I need pointed in a direction. Thank you.
