Hi All,

This is my first post and hoping someone can shed some light on this topic.

My ex pays CS on 2 children. Once to turn 18 is two weeks other is 14. The CP quit a $50K a year job a year and a half ago as she is remarried and husband supports her. Which is fine. But we got a modification to increase CS today. She is claiming she wants attys fees paid and needs more CS because my husband makes more money now and she makes less. Well of course she makes less....SHE QUIT HER JOB. This is infuriating that she can just request my more money because my husband is responsible and making more money while she is contributing NOTHING to her childrens finances. I'm told the courst MAY impute and income to her. But why is she entitled to more money because he is making more. She is supporting the kids just fine since she quit her job. This seems to be just more money in her pocket. I really don't understand the laws logic here. Can anyone explain? Thanks.

This might not work out in her favor, i believe that cs is calculated by the total income of both parents not just the noncustodial parent. I believe that there is a formula that FL uses to calculate cs. A little research will help.

I am not a lawyer.

You need to file for a modification to stop the CS on the older child in accordance with FL law or the original CS order.

It ius very unlikely she will get an increase, and atorney fees awarded. Yuor husban can dispute this as she is voluntarily unemployed.
