Car accident question while making payments on it

Hello everyone. Less than a year ago (fall 2021). My Daughter bought a 2022 vehicle and she got into an accident, (2 or 3 months after). Now I adviced her on the day of the accident to contact an attorney... (she didn't). So the story ended according to her that the car was totaled (not worth repairing it) and she lost her down payment and also the payments she was making on it.

Is that how's that works?

I myself have bought several brand new vehicles and making payments aswell and thankfully I never went trhu this kind of situation, now when it comes to all passengers my daughter suffered Some trauma she is 21. She didn't wanted to drive for days she explained to me. The other driver went to the hospital.

She didn't "lose" that money. She used it to pay for her vehicle. She chose to purchase a new vehicle with depreciated very rapidly (as new vehicles do), so that depreciation is on her.

Did they actually total the vehicle? and yes if she owes money on it and the insurance policy deems that the actual value is less than what she owes then indeed she would lose her money.

Very few attorneys out there will deal only with property issues as they mainly work PI cases.

There is always small claims depending on how much of a down payment she is missing. I will let you know that most insurance companies play games and do not care as long as their CEOs get the private plane and the second house in the Hamptons.

Good Luck with it.

Thumbs up for the above.

Awww, you were doing so well. MY opinion of insurance companies, based on personal experience, is that they abide by the terms of their contract with the policy holder.

Well let one of them not and screw you over to at least try to and I bet your vaulted opinion would change.

Maybe I should say that as well since my attitude is toward that former insurance company not my current one.

That's fine. I've had a couple of bad experiences with insurance companies but I don't paint the entire industry with the same brush.

However, I do think that oil company executives are thieves. There's no excuse for $5+ per gallon, other than the opportunity to screw the public.

The price of any commodity is directly attributable to it's demand.

Outside factors can, and do affect prices of commodities.

In many cases elected officials can and do impact prices of goods, often by fritzing with the free market forces and factors.

I'm happy to live in a capitalist nation.

Whatever I want or need I can purchase.

Heck, I can purchase one or dozens of any item.

I can purchase the cheapest one, or the most expensive one.

I'm only limited by my funding, or my need.

There is only one person responsible for the inflationary spiral unleashed on the USA.

The culprit isn't an obese North Korean dictator, nor an infirm, ailing Russian dictator.

No, that Russian dictator's aggression and invasion against Ukraine isn't responsible for the price hikes and/or product shortages.

No, don't blame the Chinese Virus or the Chinese dictator.

Yes, the person responsible for rampant inflation and product shortages, is also responsible for the ongoing aggression and invasion on our southern border.

Yes, the culprit can be found OCCASIONALLY skulking around the White House or beaches in Delaware.

Yes, the culprit, when walking has a gait similar to that of the original Boris Karloff portrayal in the movie released during the 1930s.

No, the American consumer isn't the culprit, nor is the CEO of any manufacturer or producer of consumer goods guilty of releasing these inflationary prices.

The one pointing fingers, naming and shaming is very often the true culprit.

That is ASSUMING the culprit is capable of pointing.
