Can I still get a divorce if my partner can't be found?

Hello
I'm really hoping someone can give me their insight regarding my predicament.

I've filed for divorce in Nevada and had a hard time looking for my ex.
We have no shared property and I'm not after anything. We have no kids either.
I've hired people to track down and find addresses linked to my partner.
I've hired servers to serve her 3 times in Australia.
If they failed to find and serve her can I still get a divorce?
Will the judge see my effort reasonable enough?
Anything else that I could do?

Thank you in advance.

Yes, you can seek permission from the judge for alternate means of service, perhaps by publication.

Will the judge see my effort reasonable enough?

Nobody will be able to guarantee that, though it does appear that you have grounds. You're just going to have to ask and see how it goes.

See Rule 4(e)(1):

Nevada Rules of Civil Procedure

By the way, why do you call her "partner" instead of "wife"?

You mean service by publication in Australia?
Can that be done?

Your ex? You mean your husband or wife, right? If you're seeking a divorce, then you're still married and he or she isn't your "ex" yet.

If they failed to find and serve her can I still get a divorce?

Yes.

Since we don't know the details of your efforts, we cannot answer this question intelligently.

Anything else that I could do?

Again, since we don't know exactly what you have done, we can't intelligently suggest additional things you could do.

You mean service by publication in Australia?
Can that be done?

Sure. Why not? In some cases, courts have authorized service by e-mail.

Since you're dealing with a somewhat unusual situation, you would be well advised to retain the services of a local family law attorney.
