Laws on Speeding in Houston Texas.

How do I beat a speeding ticket on my own? Please help, I need to plan my own defense.

You need not worry about BEATING a traffic citation in Texas, mate.

You get one chance every 12 months to take an online traffic school which, upon completion, allows the judge to dismiss the citation.

There is another option for most traffic citations, and it can be used more than once every 12 months.

It is Deferred Adjudication.

Some refer to it as a type of probation.

If the probation is successfully completed, the case is "dismissed."

A defendant will enter a guilty plea, but the judge does not find the defendant guilty and instead "defers" the finding of guilt for 60 to 90 days.

The waiting period is set by the court where you make application for deferred adjudication.

If you were cited in the City of Houston, here is the official city website where you'll find how you might be able to assert this antidote against what might be ailing you:

Requesting Deferred Disposition

Good luck.

I don't want to pay anything, I just need information on speeding laws here in this city and plan a good defense. However, thank you for that.

Yes, many people say that same thing, good luck with that.
I don't want to pay the IRS a dime, either.
Unfortunately, the IRS steals MY money before I get a dime.

Once they getcha, you been got.
They very seldom allow you to get away.
That is why they TRY you in THEIR courts.
Its rigged, mate, rigged.

How do I beat a speeding ticket on my own?

Depends on the relevant facts.

I just need information on speeding laws here in this city

Speeding laws are typically (if not exclusively) state laws, not local laws, but what information are you seeking? What law have you been charged with violating?

So you're telling me there's no way I can fight a speeding ticket and win?

It's certainly possible to beat a speeding ticket, but any sort of abstract discussion about the subject is pointless.

What are you charged with doing, and why do you think you have a basis for fighting the ticket?

I've been charged with speeding 48 in a 30 zoned speed limit with a radar while multiple cars driving by. I just need solid points when my trial is before the judge not jury, I've never done this before I have no clue what to do. I want to have everything set, and right now I wouldn't know what to say or how this procedure would go on my later assigned court date.

You won't ever see a jury over this. You might get 5 minutes in from of a judge.

Were you actually speeding? Are you prepared to explain how the officer is wrong or his equipment malfunctioned?

The odds are greatly against you, but you can try your luck.

You won't ever see a jury over this.

Our Texas constitution allows a defendant charged with a criminal, traffic, or other minor offense to demand a trial by jury.

The rub with that right is, if you are acquitted (or charges dropped), you don't pay for the jury.

If you receive a guilty verdict, you must pay fines, costs, fees, and for the cost of empaneling the jury.

Wow...
Despite the potential costs I doubt many people push for a jury trial over a traffic citation.

If the only argument offered is that others were driving the same speed then the matter is a certain loser :(

I still don't understand what your question is. Do you deny you were speeding or have any basis for challenging the ticket? If not, why not see if you can attend traffic school to get rid of the ticket.

So how do you think I should find it?

Find what?

You've probably seen the person that would demand a jury a few times.

They're out there.

You have not yet said why you intend to fight it.
Were you speeding?
Do you believe the officer made a mistake?
The circumstances and your reason for fighting the citation should indicate to you what action to take.

I believe I wasn't speeding at all, I work for a medical transportation company. I wouldn't drive that much above the speed limit.

So how do you think I should [fight] it?

Depends on the relevant facts and circumstances.

You wrote that you believe you weren't "speeding at all," but then you wrote that you "wouldn't drive that much above the speed limit." That implies that you're not really sure whether you were speeding or, if you were, by how much.

It sounds like you have no evidence to support a challenge to the ticket, which means it will simply be a matter of your word against the cop's, which means traffic school may be your best option, if it's available.
