I went to an apartment complex and viewed one of their apartments. I asked for a wheelchair accessible apartment, and was assured that they had one available. I signed the lease, and it had stairs leading to the apartment. I asked for compensation and the only thing they were willing to do was to waive a relocation fee if I signed a new lease at a higher rental rate per month. What are my options?

Did you ask for a wheelchair accessible apartment because you need it? If not, why did you ask for it? Did the lease you signed expressly say that you would be renting a wheelchair accessible apartment? Why would you sign a lease without knowing that the apartment met your needs?

What are my options?

Depends on how you answer my questions above.

I hate where I live, and want to put up a sign that says "I wish I never moved here, beware" on my patio so it shows towards outside. In my lease it has a paragraph that says: "occupants or guests may not engage in a loud or obnoxious manner; disturbing or threatening the rights, comfort, health, safety, or convenience of others (including our agents and employees) in or near the apartment community; disrupting our business operations; manufacturing, delivering, possessing with intent to deliver...etc." Can I still put the sign up or is it disrupting their business operations?

To specify I requested a wheelchair to be able to get into my home for my father, and that I did not need the apartment to be accommodating (bathtub, cabinets, etc). The lease is a very cookie cutter broad lease, and did not specify anything about the apartment itself. I signed the lease when I asked if they had an apartment where wheelchairs can get in specifically for my father and the agent replied yes, and gave me the apartment number to request the lease for. Since its a big community I just took her word for it. I emailed them prior, and they admitted that that is what they told me, but there was nothing they can do. Thank you for the reply.

You certainly can put the sign up. I strongly suspect your landlord will regard the sign as a violation of the provision you quoted, but I think it's probably iffy at best. More importantly, what do you hope to accomplish by doing this? If I walked or drive past your place and say such a sign, I would regard it as reflecting more negatively on you than anything else.

If you hate where you live so much, why not just move?

So...what you're telling me is that, despite having had the ability to verify that the unit you were agreeing to rent had wheelchair access, you failed to confirm that before signing the lease. Correct?

Assuming that's correct, I think your options are fairly limited. You apparently have been given the option to move to a different apartment that has wheelchair access. Won't that solve the problem? You said something about the landlord paying you "compensation," but that wouldn't appear to solve the problem. Right?

So your answer is I can. Please keep all responses professionally, and keep personal feelings and opinions separate. I don't see how you walking past my house is relevant. You cannot just up and leave in a lease, why else would they make you sign a year-term contract? Thank you for the reply.

No one on this website can give you LAWFUL permission to do or not do anything.

Whatever you do, or choose NOT to do is your discretion as a person above the age of majority.

That said, the poster simply said you have the ability to place the sign.

Heck, anyone has the ability to place the sign.

That was in way intended to imply you were given permission to place the sign, because this is a privately owned website and is in no way connected with an official governmental agency.

That said, as Sgt. Preston of the RCMP would say to his dog King, at the end of the each show, "This case is closed."

So, too, are BOTH threads, CLOSED.

I suggest you discuss your concerns with YOUR lawyer.
