That question makes no sense. I just wrote that it's not a crime (in California where your IP address is). It might be a crime in other states. That it's a crime some place and not a crime some place else doesn't mean that yes and no means the same.

As you posit your query, "sex for money is it adultery" has no meaning under the law in the USA.

There is ONE exception, adultery is a prosecutable offense under the Uniform Code of Military justice, which applies ONLY to uniformed members of our armed services.

Adultery operates against unit morale, cohesion, and operational efficiency; as such, it is an offense prosecuted under military law (at the discretion of the convening authority, usually a general or flag officer, commanding).

Therefore, "sex for money, is it adultery" in the civilian world itself isn't a prosecutable offense.
Th prosecutable offense in the civilian world is prostitution (the money for performance part), not the adultery part which is strictly religious oriented in the land of civilians.

You're right. You don't get it.

If you want to commit adultery (cheat on your wife) go ahead. Just understand that there may be no consequences if she never finds out or there may be lots of consequences if she does.

If you need the potential consequences spelled out for you they can include divorce, lose your kids, lose your house, pay spousal support, pay child support.

If you want to pay a prostitute go ahead. Again, there may be no consequence if nobody ever knows and there may be bad consequences if you get arrested and your wife finds out.

If your worried about your marriage it doesnt matter what you call it your wife can divorce you and get half your stuff. In addition she does not need to prove adultery to end your marriage. You can call it whatever you wish sex outside your marriage IS adultery. Does that answer your question? this hardly seems a legal question since CA is a "no fault" divorce state
 
It's a Class B misdemeanor here in NY but I'll bet it's been at least 50 years since anyone was prosecuted for it.

So from everything I read, if I'm in California having sex with someone other than my wife, it's not jail time. The same applies to States that adultery it's not a crime.

There's a distinction between LEGAL, and NOT CRIMINALIZED.
They are similar, but not the same.
