    Magistrates order for Emergency Protection

Can a Justice of the Peace issue this order? I am assuming that this is actually referred to as a temporary ex parte protective order. If so can a detective be the person filing the application or the person requesting it be issued?

    Prosecutor refuses to Reply

Sorry so long to reply. The problem is my attorney is five hrs away. He said the prosecutor told him he couldn't give me copies. My understanding is she let him have copies but as an officer of the court he can't allow me to have copies. Prosecutor is being a pain, the statute says...

    No copies

This relates to Discovery, Is there an actual legitimate reason that people aren't allowed copies of the information in discovery? I mean seriously, you and your attorney get to read everything so the info is not a secret, yet the state still insists that defendants not be allowed to have...

    Rules

Oh I don't know, the prosecutor hasn't shown up twice already. How about a dismissal instead of resetting. If I didn't show up it wouldn't be reset I would go to jail.

    Rules

I am looking for the rules that govern the procedures in a criminal trial> Specifically, things they can and can't do. I have been told it's the "Rule Of Civil Procedure" but have also been told that is only for civil suits. The Code of Criminal Procedure isn't very specific seems to only...

    Discovery

Thanks Judge, The info was interesting and helpful academically but my problem is a bit more serious than I previously stated. If this wasn't happening to me I would have a hard time believing it without some proof. That is the problem, since This began I have been given amended bond...

    Discovery

Thank you for the reply Judge, but much to my dismay i have recently found out that you don't get copies if the prosecutor says no. At least that is what my attorney has said. I live five hours away and can only look at the paperwork at his office. i am quite put out about the whole thing...

    Discovery

Depending on the prosecutors permission or denial of whether or not you can have copies of the information it contains. My question is; Is the file you see the actual file from the DA's office or is it a copy that has been given to your attorney?
