We rent a senior 55 plus for $1210 a month. The manager gave a notice that it will go up to $1260 but everyone else went up to $1245. When I ask the manager she says "It's a mistake, The new rent is $1260". Is it legal to raise ones rent more than others?

I was involved in auto accident on may 8 2007. his ins co kept promise to pay. I filed in small claims but the first date open is may 24, 2009. Is this too late? because it's after 2 years even though I filed before 2 years. also, I named the driver in the suit. Is this correct?
