Here's the basic breakdown. Last week, we found out that my fiance's daughters Mother had left her husband, and left fiance's daughter in the care of the stepdad for over a week without a word to anyone including the daughter. She does drugs and we assume she has been on a BIG binge for the last 3 weeks. She signed a notorized statement signing over temporary custody, and we have been keeping a journal of every interaction.
They have joint legal custody, and the original order stated that the child shall live with the Mother. We went this morning and filed a petition to change/amend the original order to sole custody with visitation to the Mother, attaching the affadavit, and copies of the journal. She just called tonight after 4 days of no calls, and says that in the end of July, she wants the child back.
What should we tell her now that papers have been filed, and what if she gets served, and comes to get her back? The mother even withdrew her from school ( she had missed quite a bit anyway) and we immediately had her enrolled (she started today).
Our lawyer is out of town for the next 2 weeks, and said he should be back by the time she gets served. But her mental stability may make her try and come grab her.
What should we do? If and when that happens.
