Needing to know about signing over rights

My fiance's exhusband is in jail for drugs. She has full legal custody of them. He doesn't pay child support, and can only visit the children when she allows him to. She went to see him in jail today. to ask why he hasn't tried to contact her about the kids in the last month. He stated he didn't want anything to do with her or the kids. Our question is, are there any papers that we can file so that he can legally sign away all his rights? Or is there anyway I could adot the kids before we are married? By the way I am looking for the laws covering the state of Texas.

A: Yes, if there is an adoption with a new daddy waiting in the wings. There may also be other grounds for termination of parental rights. Consult a family law attorney.

A: I doubt it, but I have seen stranger things happen. Again, ask that lawyer.
