I'm trying to understand how delayed diagnosis cases work from a legal perspective. If a doctor doesn't diagnose a serious condition in time and the delay causes the patient's health to get worse, can that be considered medical malpractice? What factors do courts usually consider when deciding whether a delayed diagnosis resulted from negligence rather than an unavoidable outcome?
I'd appreciate any general legal information or examples. Thanks!
