overprotective grandfather and 15 year old pregnancy

Why are you so nasty? I wasn't being a jerk...I am trying to understand how an attorney could state what you did. I am confused by the reasoning behind your assertions. Hence the  icon. When a minor has a child, a social worker visits with her and her parent/guardians to determine...

overprotective grandfather and 15 year old pregnancy

Well...Yes. The Supreme Court, that ruled parents have sole care and control of their children unless found LEGALLY unfit by a court. The GP's have custody of their child. Mom has custody of HER child. Being under 18 doesn't mean you lose custody automatically. I just don't know how an...

Just a heads up...Lonlyinny is a law forum troll that has been banned off of just about every legal site on the net....Her "m.o." is to necropost (VERY OLD and dead threads) that, for the most part, pertain to custody matters. If you see one of her posts just check the date...most of them are to...

Ahhh...No. That is not true. At. All. PARENTS have custody of their child...Even if they themselves are legal children.

    my 17 year old daughter

You are totally responsible for your MINOR CHILD'S care and wellbeing. Why didn't you obtain a restraining order against this guy? Why are you allowing your CHILD to run things? If this were my Daughter I would have placed he in a mental health facility to determine why she was allowing...

does father in question have rights

The Legitimization process is not required in IL. That is a GA "thing".

does father in question have rights

No. At this point you have total care and control of the child. That he is a PROVEN danger to the child. If he has a criminal history of crimes against children that COULD be considered. But from what you have described he is not a danger to the child. Again none of this will prevent...

im 17 ang pregnant how can i et emancipated fast

Am I missing something? The OP never mentioned her state. She could be anywhere including California where the AOC is 18 and once paternity is established her 24 year old boyfriend is looking a felony rape charges. She will not be able to this guy if, per statute of her state, he raped her. She...

im 17 ang pregnant how can i et emancipated fast

What state are you referring to here? Or are you referring to Federal Stat's?
  12. B

I wish to become emancipated based on my situation.

If you are not "certain" of the law for California...Why are you posting to the thread? What are you implying here? That by turning 17 a LEGAL CHILD doesn't need emancipation to LEGALLY move from their parents/guardians home? Can you post a statute to ANY state that would support this assertion?

    Does he have any rights?

This thread is fourteen months old. I highly doubt the the Original Poster is gonna come back. Could Mr Harris and Kellytroll please not revive old/inactive threads please???

Mom from MI wanting to move out of state

The court isn't telling you that you can't marry and move to Massachusetts...They have ORDERED that the children can't be moved. It's a done deal unless you submit an appeal based on a MISTAKE in law that the Judge made. So move to Ma. and Dad gets custody, or not. Your choice.

    Boyfriend refuses to leave.

    Not really.
  16. B

Can I move to another state if I have shared custody with the father?

She can move where ever she wishes. She needs to file for a modification in custody so that Dad is Primary Custodial Parent and she should also submit a long distance visitation plan.

    Boyfriend refuses to leave.

He has just as much right to live there as you. If the situation is as intolerable as you portray...move when the lease is up.

    Common law rights

Neither NY or PA are common law states. Unless he has signed a POA giving you the right to make decisions for him, you have no rights.

    I have a friend

Perhaps. But without knowing WHY the teen is living with Dad and not her Mother and siblings, we can't know if there is sufficient cause for a suit.

    I have a friend

She can't. CHILDREN do NOT get to decide with which parent they live. When she is 18 she can then move to Texas and live with Mom.
