No. You are misunderstanding the law. In a unmarried situation the mother is the ONLY parent. Therefor she is, by law, the primary care giver. GENERALLY. Read the case law for your state and you will see what I mean. :)

Go to the police and report the rape of your daughter, the parental interference and expect to have some VERY hard questions to answer regarding you total failure in parenting this child.
You have posted very limited information regarding the NCP's involvement with the children. How often does the NCP have the children? Is s/he paying court ordered support? How is it in the CHILDREN'S best interest to move?
