At what age will the Court Consider the childs wishes as to who he lives with?

Both kids are MUCH too young to decide where they want and in the event of one parents death, the other one generally gets custody. All you can do is petition for visitation and if you are lucky you'll get it.

Ex's Crazy Accusations I need advice!! He wants children removed.

The fact you had 3 kids with an illiterate white supremacist is totally fascinating to me. You apparantly thought he was good enough to father your 3 kids. Geez. That sounds totally ridiculous.

Ex's Crazy Accusations I need advice!! He wants children removed.

With no attorney I can tell you, you are going to have a very hard time. Also you have almost no chance of getting supervised visits for Dad since you cannot prove anything and if the daughter is in his care now, it is going to be hard to get her back. You cannot ask for supervised visits solely...

Can Adoption be against a fathers will?

Generally no unless mom pulls some shenanigans. Dad needs to see an attorney now and get a court ordered visitation schedule set up and take mom to court for contempt if she is not allowing visits. Mom normally cannot get a boyfriend to adopt anyways.

Or maybe people should be a little more selective on who they have kids with? The pendulum swings both ways. Your husband does not have any business telling you to block visits. He signed up for this when he married someone with a kid. If you can get this guy to terminate rights that is fine...

can my daughter really lose her baby?

Well it sounds like to me the baby is not safe with either mom or dad if you ask me. Have you considered getting guardianship of the child? Mom had a baby with an idiot now she has to deal with him. If paternity is not established I would completely stop communication with dad and his family...

So you want to use the child as a pawn because he is not paying support? No you cannot and you can be held in contempt. If Dad is not paying court ordered suppor then you file contempt. Your thought process on this is completely wrong as it is NOT in the childs best interest to not see their...

    Custody - Unwed Father

It sounds like paternity was not legally established if you did not sign the birth paperwork so technically you could be forced to give the child back. I do not know what you are waiting for. Google establishing paternity in your state or go down to the court and file for emergency custody asap...

    Child Support Question

If you moved then you created the distance. It is possible the courts may give him some travel credit. You really need to go through the courts now since you have several issues. Jurisdiction should go where the child lives as long as you meet the residency requirements. He won't be required to...

    Child Support: Proving EX's Employment

Do you actually have a court order? Were you given permission to move? If you file for child support they have a way of determining if he is employed. If he is a sub contractor it is a little hard to prove.

    Foster Care Custody

Yes I think you have a strong case. Is there a CASA on the case? The baby has bonded with you and not Grandma and I think Granda might have some sort of ulterior motive for wanting custody. Clearly she should not be of any advantage over you just because she is a blood relative. She declined to...

    Child Support Question

A full time income will likely be inputed for you. You are expected to work full time so if you work part time that is fine but a full time income counts for you. Your CS amount sounds a little low. You really need to google what the MN child support guidelines are. Generally both parents...

Is it kidnapping if I don't bring my son back to his mom?

Was paternity ever established? Did you sign the birth paperwork? What state are you in? Depending on your answers to these, then I can help you more. At any rate, if mom has all these issues, why haven't you filed for custody? It is in your best interest to file for custdoy now before mon does...

    scared for my daughter

Not really. Why is she threatening this? Document the threat and file for custody. How old is the child? Is the child troubled?

    getting my son

Was paternity ever established? I agree you need to file NOW while your state has jurisdiction. You do have a chance of getting the child returned to you.

You certainly do not have to listen to him. You can take what you want and he can try to sue you for return of them.

    i cant take it anymore

I hope you do not have any kids with him. You might qualify for an annulment but honestly sometimes it is just easier to get a divorce.

    Divorce stipulation

You can certainly ask for joint legal. I would not listen to your wife. You really need an attorney.

Divorce, kids and moving out of the house

You still have rights to the kids but you should file for divorce and get a temp, visitation agreement if your wife will not cooperate with you. You are not abandoning your kids by simply moving out. By the way you do not have to pay any expenses without a court order. If you and your wife want...

    Need Help..... = (

Dad has rights here and if you want visits you need to see an Attorney in AK. I doubt your daughter legally terminated her rights. She may not have any rights at the moment though. Without seeing an attorney for grandparents visitation (which is possible since the child lived with you at one...
