    That wouldn't fly. The officer needs to not only read the rights but in a situation where there is a written statement they would get a written statement of rights signed by the Defendant.

    If he can prove that he can not pay vs he does not want to pay he is not in contempt. Many times a judge will put him in jail anyway for a time to see if he can pay somehow. I have been working on just such a case for the last month now.
