Can I have my civil case thrown out?

I wondered how long it would take you to see that it was for $150 Army! I love the "Dude" comment. You must have grandchildren! I agree though, I would just pay it.

Consumer Law, Warranties I wrote a promissary note for a car. am I legally bound to buy?

Well I wouldn't be so quick to say there was no bill of sale as if there was no contract. He should have taken a deposit, even if it was $10, but the elements of a contract do exist in your note. You have definite terms, you have offer and acceptance, you have mutual consideration, and you...

Bank of America/ Taylor Bean & Whitaker

Really you shouldn't have too hard a time finding an attorney to do that. BOA has deep pockets and they violated the Fair Credit and Reporting Act which provides for attorney fees. Further BOA is clearly wrong. Truthfully I would be surprised if BOA even fought an attorney in the matter.

    Consumer Law, Warranties estimate

Did the estimate have any warnings about overruns and how they would be handled? What is his excuse for being 2x+ over his estimate? Did he give you any warning before running over his estimate? Generally he is stuck to the estimate unless he made some arrangements with you during the process...

Consumer Law, Warranties I wrote a promissary note for a car. am I legally bound to buy?

There is nothing more heartwarming than someone who is willing to renege on a promise to buy. You agreed upon a price. You say you gave him a promissory note? Did it say, "I promise to pay" etc? If you did a bill of sale and a promissory note with terms of repayment he can probably sue you...

Father left son with a $12,000 credit card debt

Your only choice is for him to go after his father. Despite what Army is saying, I would sit down and work something out with the father because he did something wrong. he should pay the card. The credit card company does not have to recognize fraud because in their position there is no fraud.

    fell in hole

While army is right about sovereign immunity they usually waive it up to 25k dollars or so. You have a case, see an attorney. You aren't going to be a millionaire but you will get your med bills paid.

who has custody?? what do we do?

If you are not in Ga there is no "legitimation" that you have to file. I'll do some research on NC later but I imagine this is the answer. First, ignore lonely, she has some issue with child custody and stepmothers. Second you need to file for custody of the child. I would file a permanent...

Driving on susp.license while on probation in Georgia, looking to move to dismiss

Ironfist, I'm from Cobb County Georgia and I have dealt with this very issue before. When you entered a Nolo plea your license was NOT suppose to be suspended. The correct move is to go after the suspended license charge not the original Insurance charge. Check your private messages and I'll...

    Relief restraining order

Quietter, if you just stick to the story that he did not mean to hurt you, and he doesn't plead guilty, he will win the case. They have no means of proving anything except by your testimony. If you maintain that he did not mean to hurt you and that you lost your balance and fell, he will be...

    all too many problems

Despite what ArmyJudge is saying you did NOT molest her or rape her. In PA 16 is the age of consent but 13, 14, 15 is ok if the other party is not more than 4 years older. You are two years older so its not felony statutory rape. Now it may be considered corruption of a minor but I really...

Question on a bad business transaction

If he puts a mechanic's lien on your vehicle he has a certain number of days to sue. He will have to prove that you owe him. I would hope you have some receipt for the money you paid him but the fact that he released the car to you is pretty good evidence. I would not worry about the lien or...
