Drug Crimes, Substance Abuse Drug Trafficking vs. Drug User

CDWjava is of course right. If you have two ounces of cocaine they are going to say that you have the intent to distribute, but absent some supporting evidence they are going to have a hard time making that stick. Nonetheless if you have a half kilo you are going to be hard pressed to show...

Drug Crimes, Substance Abuse Alaska 6th Degree Misdemeanor

I personally would put it down. I would explain it by saying that the passenger was found to have a small amount of pot on her and it was never found to be yours/hers whoevers. Having a misdemeanor isn't going to tank you, but lying about it will. Let's see how honest you or your friend's...

Drug Crimes, Substance Abuse Drug Trafficking vs. Drug User

If you have a certain amount of a drug you will be charged with the "intent" to distribute. It is a "rebuttable presumption" in the law. Things that will work against you are a large amount of the drug, unused baggies, having the stash of drugs "bagged up" in small units, having scales, and...

Alcohol & Drugs: MIP, MIC, Intoxication Mip?

We don't have access to city ordinance books. If you don't have an attorney you should plead not guilty and get them to appoint and attorney to you. Most likely if you plead not guilty an attorney will be able to put you in a diversion program where you will have a drug and alcohol class, a...

Consumer Law, Warranties is a verbal agreement to pay back loan binding?

He will likely admit that you paid the credit card off for him but claim it is a gift. No Judge is going to believe that, too much money. If he has the money to pay and simply is not paying then sue. If he has no money to pay the suing is like pissing in the wind so to speak.

can 2nd mortgage creditor garnish wages when 1st mortgage was forclosed?

Drug Crimes, Substance Abuse Arrest Warrant & Trafficking in Heroin

They made the arrest to see if you would tell on yourself. Keep your mouth shut, hire an attorney and let them work. You have a decent case on parts of it but not so good on other parts. Unless there is a Narc, you won't go down for selling in a school zone. The enhanced penalties are unreal...

Car Dealership Cheated Me Out of Trade

Not only am I an attorney, I own a Car dealership, so I'm a bit familiar with the trade. If you have a dealer's license then why on earth would you be buying from another dealer at retail? I could buy that same truck you bought for 6-10k. No one sold you a used truck with a "guarantee" that...

    traffic school

The effect is different from state to state. No it doesn't get rid of the ticket completely, especially not driving on a suspended license. If I were you I would get an attorney before you find yourself in jail over that ticket.

Can I sue my loan officer? Please need answer

Forget the Loan officer who were they working for? Don't be so quick to sue, find out who has your loan. The Broker they worked for should be able to salvage the deal. But yes you have a case against the loan officer but can you collect from them? I doubt it.

daughter lawyer didnt present alternative punishment or evidence

Cyndid18, I know she is your daughter and a three year sentence seems to be forever, but she will be through it before you can even address a habeas corpus petition. You certainly do not need to pay anyone 30,000 dollars. Your appeal is already out of time, she can not file. She can file an...
