The dad will not let the mom visitations happen.He kicked her and 2 siblings out last May and absolutely refuses to let any of the siblings or Mom court ordered visitation.The 9 yr old sister and 6 year old brother rally miss Jao, he is 3. he refuses to appoint any one at all. we have missed over 30 weekends, TX court ordered every other weekend Friday at 5 to Sunday 5. Mom is a single mom and has no money for a lawyer. I can't believe the ridiculous retainers and then the hourly charges to go with it...no wonder moms are screwed and barely hang on to raise good kids.
So the question is Why, Just because his attorney is a damn good one at putting a BS lying story together, works as a lawyer for the local city police so you know they didn't help when he mentioned his lawyers name to them. Making unrealistic demands on paper like 3 nail drug tests,,,C'mon man... she passed the others why make it impossible for her.. we know.This was all done in 2020 in 30 minutes on Fricking ZOOM COURT... what a joke. The games people play.. BTW, The Insane clown posse band lover sperm donor dad has a big rap sheet and by threatening to have some Juggalo family friends make the moms life hurt by telling what he had 2 juggalo's females do toxic an old girl friend out// this was all after he spent time for being high and shooting his wife in the neck...
So how do we stay on the right side of the law and get to see the kid without hassle, intimidation and fear mongering .what paper has to be filed? A simple Modification to the existing order, Can someone/Lawyer get this done for under a Million ???

My legal advice is to chill.

Mom chose the Dad, so on some level she at some point thought having sex with him wasn't a horrible idea. After all, it wasn't rape. So, stop dissing the father of your grandchild. Since he currently has custody, he's not just a sperm donor.

The way Mom can help herself is to be a model citizen and get organized and diligent.

1) If Mom has ANY drug use, even legal drug use, then she needs to STOP. That way random drug tests are not as much an issue.

2) In interacting with Dad, Mom should be civil, factual, and direct. Communications should be documented. Some courts have specific apps that they prefer. Even if arrangements have been discussed verbally, follow up with a written/typed recap.

3) In legal settings, Mom needs to be quiet unless answering a question, and calm. Not even a funny face when she is being accused of something outrageous.

4) Mom needs to ATTEMPT to exercise her court ordered visitation. ALL of it. Whatever the court order says, try to follow to a T. If Dad refuses to help facilitate visitation, Mom needs to document it. Mom can ask around to determine what forms of documentation would be admissible in court.

Patient. Your daughter needs patience. And you do too.

If there's a court order and the father isn't complying, then the mother should seek to enforce it. As far as I know, no family law attorneys from Texas follow these boards with any regularity.

Well, actually, there is no "we." The mom alone needs to deal with this and not make things worse by having someone (you) else butting in to a situation that doesn't concern them.

The term controlled substance does not equal illegal drugs nor does it always indicate the the drug would impair the person's ability to care for a child and do other basic life activities. So for some people, just stopping the drug is not an option. When the drug is necessary and CPS makes an issue of it, you need to get a hearing with the judge so that an expert can explain to the judge just what the drug is for and how it affects the people taking it.

If Mom hasn't tried much to find free or low cost legal help, she ought to spend some time doing that. Three good places to start are the Texas Legal Services Center; the Texas Access to Justice Commission, which partners with the State Supreme Court and the Texas Bar (which are both different from the bar association); and the law schools in the state that offer legal aid clinics.

True. I'm thinking more along the lines of recreational use, rather than legitimate use.

OP is alleging that Dad is a drug dealer with a rap sheet, and OP is complaining that 3 nail drug tests for Mom are an unreasonable demand, without stating why. So I'm inclined to think that Mom and Dad share some hobbies or have some related/complementary hobbies.

But perhaps that is just me reading between different lines.
