Eviction Process With holding rent

I live in the state of New York.
Can a tenant with hold some rent if a landlord refuses to make repairs and or exterminate
 
Are you in New York City or elsewhere in the state?

In general, you can, but there are steps you must take that are different depending on whether you are in the city or not.
 
Landlord adamately refused to make repairs, would not exterminate for roach infestation, this was from when I first moved in, 4/1/2018.
I viewed the home in Feb 2018. Tenant still occupying. When I moved in 1 day after tenant moved out, I was overwhelmed!!

Yes I informed landlord immediately. He had me take pictures and send to him so he could keep the former tenants security.
He offered no assistance to me after numerous phone calls, contact and certified mail. Come June, I charged him by deducting from my rent.
Spoke with him 2 weeks later, he told me don't do it again, call him and he'll do repairs.
Nothing came of it until this month. He's using it as an excuse to evict me of non payment of rent.
