who is responsible?

need help...here is a situation. Friend hire a weddding planner, who took care of everything from planning to paying all the vendors that was hire by the planner. Order wedding and grooms cake, did not like how it turn out ( but the other cakes that was on the website of the baker was nice.) Planners are willing to give refund on payment that was charge to planning, order and deliver the cake. The baker said that it's the planner responsibility to give all the money back to the bride because they pick up the cake to deliver. But even thouhg the planner was refunding their portion of the fee they said that it was the baker responsibilty for the refunds because the money was paid to to them by the planners, cake was sent back to the baker with out being touch (eaten). any advice?

Your claim is against the planner. They subcontract the baker, you don't have any direct relationship with the baker, so the baker is not responsible to you.

If the planner is serious about refunding your money, they will refund the cost of planning/ordering/delivering the cake as well as refunding the cost of the cake from the baker. They can then try to recoup that money from the baker, or not, as they wish - that's got nothing to do with you.

I would hazard a guess the planner's claim against the baker is pretty weak, and the planner suspects they're not going to recoup anything from the baker, so they're avoiding giving you a refund on the cake. Telling you it's the baker's responsibility is a cop-out.

Actually, in the planner and baker defense ( nothing against the friend) There was not anything wrong with the cake, the mother of the groom did not like it because it was not up to her standard and told her to take it back. (they were having a rough day becuase everything was not going her way tropical storm was hindering the day with 45mph wind and rain.) She didnot want to deal with the planner so she called the baker herself. Everything else that the planner did was top notch best wedding that came out of the bad day. We have talk to the planner and they never put the blame on the baker, but the baker was bad mouthing the planners so we are stuck int the middle. They was trying to come up with most of the refund but my friend wanted the refund from the baker and now since the baker won't do it we have to go back and tried to get the refund from them.
