Who can be declared administrator of an estate?

My father passed away in December of 2003 without a will. As far as his estate is concerned, I do not know what is involved. My aunt has possesion of all documents relating to his estate.

My mother and my father got married when I was nine years old, and we all lived together until they seperated in '91 and eventually divorced in '03. My father also had a daughter (2 years older than I) which he found out about in '89. She lives in our home country.

I have been trying to have myself declared administrator of his estate so that I can know exactly what is involved with his estate. I was told by a lawyer that I cannot be declared administrator of the estate because 1. I am only a permanent resident to the U.S., and 2. I do not reside in the same state as my father did when he passed away.

I am a little confused right now as to who should be, and has the right to be declared administrator of my father's estate.
