My husband has a garnishment from the state of Colorado. He holds a Colorado Driver License and was working in Colorado until he was transferred out of state (with the same company) to Pennsylvania. I was just wondering if he now fell under the Pennsylvania law since he is working there now or if it still falls under Colorado law?

If his wages have been attached, the creditor will have to get PA to acknowledge and accept the CO judgment.

He might initially speak with his payroll manager and seek information on company policy for cases like his.

The outcome may hinge on what his legal state of residence is, rather than where he works.

Here is my spin on this

1. Judgment is out of Colorado
2. Judgment debtor is a resident of Colorado
3. Judgment debtor works for a Colorado company
4. Employer received writ of garnishment and began garnishing wages
5. Employer sends judgment debtor to another state to work at another facility.
6. Judgment debtor still is a resident of Colorado and still works for a Colorado company. He just happens to work at a facility not in Colorado (not uncommon-think of the Four Corners area).
7. Judgment creditor does not have to domesticate the foreign judgment in the other state as it is not seeking to enforce the judgment against a resident of that state.
8. Wages continue to be garnished.

Ever consider filing bankruptcy?
