I am wondering what evidence is a judge looking for when I need to establish that the mother of my child has voluntarily relinquished primary possession of our daughter to me. I have had her for the last 2 years, 5 to 6 days per week. There are numerous periods where the mother didn't see the child for 2, 3 or more weeks although I tried to make arrangements for her to spend time with her that she declined.
Ever since we broke up in 2004, I've had her in the least 4 days per week.
I need to prove this to the court, so how do I go about doing so?
My daughter is 4, and I was never married to the mother. I am the legal father. We did have an order that went into effect June of 2003 regarding custody and support though. She was desginated as primary conservator and I was designated possessory conservator and standard visitation.
