Alcohol & Drugs: MIP, MIC, Intoxication very late possession summons

Two years ago, the police were called to my home and they found about 3 grams of marijuana. The officer didn't write up the summons (for possesion of marijuana, 1st offense--class U misdemeanor) until about 8 months after the occurence(according to the warrant), and it has taken a year and 4 months for it to be served to me. So the actual incident happened OVER two years ago and I'm just now being charged. I no longer use the substance and want to know, since so much time has passed, if the state can still charge me without me being previously notified of any charges? How serious could my punishment be?
