Transferring burial plot ownership

When my father passed away my sister and her husband paid for everything with my dad's money. They have since divorced and my sister has now passed as well. My former brother in law will not transfer ownership to our family,what can we do? My mother is still alive and I have pOwer of attorney.

You can sue him, and try to get the value of the plot (in small claims court).
Or, take him to court of record and sue for special performance.
